These Terms & Conditions (the “Terms”) govern your access to and use of the SoilWater website at soilwater.com and any content, documents or materials made available through it (together, the “Site”). The Site is operated by SoilWater (“SoilWater”, “we”, “us”). By using the Site you agree to these Terms. If you do not agree, please do not use the Site.

Use of the QSoil platform and any account-based services is governed by the separate QSoil Terms and Conditions, which prevail over these Terms for that service.

1. Use of the Site

The Site is provided for general information about SoilWater’s consulting services, the QSoil platform and the TerraScape family of soil amendments. You may view and download material from the Site for your own reference and internal evaluation. You must not use the Site:

• in any way that breaches applicable local, national or international law or regulation;
• to attempt to gain unauthorised access to the Site, its server, or any connected system;
• to disrupt, overload or impair the Site or interfere with any other party’s use of it;
• to access, scrape or index the Site by automated means without our prior written permission.

2. Information on the Site

Content on the Site, including figures relating to yield, water use, soil carbon, microbial biomass and other outcomes, is provided for general information only. It may be drawn from field trials, partner research or managed sites and does not constitute a representation, warranty or guarantee of results for any particular site or project. It is not professional, agronomic, engineering, financial or legal advice, and should not be relied on as such. We may change or remove Site content at any time without notice.

3. Intellectual property

All intellectual property rights in the Site and its content — including text, graphics, layout, design, logos, trademarks, the names SoilWater, QSoil and TerraScape, and all software and documentation (together, “SoilWater IP”) — are owned by SoilWater or its licensors and are protected by law.

Nothing forming part of the SoilWater IP may be copied, reproduced, republished, distributed, publicly displayed, adapted, reverse-engineered, decompiled or otherwise reused, other than as expressly permitted in these Terms, without SoilWater’s prior written permission.

4. Your submissions

If you contact us through the Site — for example by submitting the consultation form — you are responsible for ensuring the information you provide is accurate and that you are entitled to share it. You grant us a limited, non-exclusive licence to use that information to respond to your enquiry and to provide the services you request. We handle personal data as described in our Privacy Policy.

5. Third-party links

The Site may contain links to third-party websites and resources. Those links are provided for convenience only; we have no control over, and accept no responsibility for, the content or availability of any third-party site.

6. Disclaimer of warranties

The Site is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy or non-infringement. We do not warrant that the Site will be uninterrupted, secure or error-free, or that it is free of viruses or other harmful components.

7. Limitation of liability

To the fullest extent permitted by law, SoilWater will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or in connection with your use of, or inability to use, the Site. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.

8. Changes to these Terms

We may update these Terms from time to time. The version published on this page, with the “last updated” date above, is the version that applies. Your continued use of the Site after a change takes effect constitutes acceptance of the revised Terms.

9. Governing law and jurisdiction

These Terms and any dispute or claim arising out of or in connection with them or their subject matter are governed by the laws of Switzerland. The competent Swiss courts have exclusive jurisdiction to settle any such dispute or claim.
